第216期：Oyez

喜欢看美剧，尤其法律和罪案相关美剧的朋友也许在剧中听到过美国最高法院有人喊Oyez的，今天我们就来聊聊这个高大上的词。

韦伯斯特大词典的解释是：used by a court or public crier to gain attention before a proclamation.

翻译成汉语就是：肃静！

需要注意的是：Oyez一定要连说三遍。Oyez, Oyez, Oyez.

Oyez有三四种发音，在美国法庭上常见的是[oʊˈjeɪ]. （注意z是不发音的。）这个词来自于中世纪的英语和法语。

法庭上喊Oyez这个做法来源于英国。Oyez is a traditional interjection(感叹词) said two or three times in succession to introduce the opening of a court of law, especially in Great Britain.

The term is still in use by the Supreme Court of the United States.

At the beginning of each session, the marshal(法警) of the Court (Court Crier) announces: “The Honorable, the Chief Justice and the Associate Justices of the Supreme Court of the United States. Oyez! Oyez! Oyez! All persons having business before the Honorable, the Supreme Court of the United States, are admonished to draw near and give their attention, for the Court is now sitting. God save the United States and this Honorable Court.”

这是美国最高法院听证会开始前法警要说的一段话。也有时候只说完三遍Oyez就结束。

网上对“肃静”一词的解释大多都不对，很少有网站正确使用Oyez对等“肃静”一词的。如果你查国内那个什么娘搜索引擎，你会发现很多网站告诉你“肃静”就是quiet, silence. 都不对。这种东西不是靠翻译的，而是要知道真实场景中英美到底怎么说。今天的知识，你发了。

这有点像中国古代衙门在官老爷升堂时喊的堂威。衙役分列公堂两侧，手杵水火无情棍有节奏地敲击地面，同时齐声喊“威~~武~~”。据说之所以喊“威武”是取“威武不能屈”之意，一方面给犯罪嫌疑人以心理震慑，同时告诫无辜的嫌犯要坦白真相，不能屈服于权威或武力。但实际上，“威武”一喊，好人坏人基本都吓尿了。
