第773期：恐怖的新加坡鞭刑 – caning in Singapore
去过新加坡的朋友们都知道新加坡有句名言：Singapore is a fine city.
这里的 fine 可不是漂亮和好的意思，而是罚款。说的是新加坡法律很严，很多事会被罚款或处罚。当地人就戏称为“罚款之城”（fine city).
今天我们来聊一个有点吓人的话题：新加坡的鞭刑。
鞭刑的英文叫 caning，是 cane 这个词的动词形式。
cane是手杖、藤条的意思，本身也有动词的意思——用荆条打。认识 sugarcane 甘蔗就能记住这个词。

很多人说新加坡的鞭刑是早期福建移民和黑帮留下来的残酷刑罚，但其实这还真不是华人的发明，而是19世纪英国人带到马来亚的。
英格兰和威尔士历来就有对犯罪分子抽鞭子的处罚传统，称为birching（用桦木条打）、flogging（用鞭子打）。
这种鞭刑主要适用于下面几种恶性犯罪：
- robbery 抢劫
- aggravated forms of theft 恶性盗窃
- burglary 入室盗窃

assault with the intention
of sexual abuse 意图性侵的攻击 - a second or subsequent conviction of rape 重犯强奸
-
a second or
subsequent offence relating to prostitution 重犯卖淫 -
living on or trading
in prostitution 以卖淫为生或淫媒
1957年，马来亚宣布独立。1965年，新加坡脱离马来亚后，两国都把英国殖民者的这种鞭刑刑法保留了下来。
这就是新加坡鞭刑的来历。
但新加坡发扬光大了英国人古老的鞭刑，并且规定适用于更多犯罪行为。读一下下面这段新加坡法律规定的鞭刑适用罪行，也难怪每个人在新加坡都乖乖地不敢违法了。
Singaporean law allows caning to be ordered for over 35 offences,
including hostage-taking/kidnapping, robbery, gang robbery with murder,
rioting, causing grievous hurt, drug abuse, vandalism, extortion, sexual
abuse, molestation (often referred to as “outrage of modesty”), and unlawful possession of
weapons. Caning is also a mandatory punishment for certain offences
such as rape, drug trafficking, illegal moneylending, and for foreigners who overstay by more than 90 days – a measure designed to deter illegal immigrants.
你说，谁不怕？
但有三类人不适用鞭刑：
- Women 妇女
- Men above the age of 50 五十岁以上的男子
- Men sentenced to death whose sentences have not been commuted 已判处死刑尚未减刑的男子（*commute就是减刑的意思）
知道了鞭刑的来历和适用范围，最后来说说鞭刑到底有多疼。
罪犯下体脱光，趴在一个人字梯上。只在腰部以上肾的部位放个垫子防止肾脏被打坏。行刑人甩开荆条抽打犯人的屁股……
